The ongoing patent litigation between audio IC giants Creative Technology Ltd. and Aureal Semiconductor Inc. will proceed to court, the companies have announced.
A U.S. District Court judge dismissed Fremont, Calif.-based Aureal's suit for summary judgment, allowing Creative's suit to proceed to trial. In addition, the judge tossed out Creative's motion for a preliminary injunction blocking the sale of Aureal's Vortex audio chips, ruling that Creative's case was not strong enough, and that an injunction would cause unnecessary harm to Aureal.
No trial date has been set.
Creative, based in Singapore, sued Aureal in February of this year. In April, Aureal filed a counterclaim charging Creative with fraud, defamation, unfair competition and other allegations.
