FREMONT, Calif. -- Avant! Corp. here today announced that a Santa Clara County Court judge dismissed all of the charges in the criminal case brought by Cadence Design Systems Inc. against the company and all of the current and former executives charged in the case.
Avant! said the court granted its motion to dismiss the indictment based upon the district attorney's instructions to court reporters not to record certain communications between the district attorney and the grand jurors.
The Santa Clara County district attorney has the option to appeal today's decision, re-file the charges, or drop the criminal case all together, Avant! said.
San Jose-based Cadence has accused Avant! and top executives of stealing source code and technology used in place-and-route design automation software. Cadence has also sued Avant! in U.S. District court in an attempt to stop the company from selling the software in the United States. Avant! has denied the charges that its products contain stolen code.
