I thought this lawsuit was lame at the start, but it's getting more and more preposterous.
“'While we are in court here we are getting disclosed on 20 [new Samsung] witnesses-- we are getting gamed here,' Apple’s lead attorney told Judge Lucy H. Koh."
What has Apple been doing? And then there's this:
"Under cross examination, Apple attorney Bill Lee tried to raise doubts about whether the iPhones infringe the patents given the wording in the claims and the exact sequence set out in one of the claims.
"He also noted court documents in which Samsung admitted it does not use any of the patents in its current handsets."
Even if it's true that Samsung isn't using those particular inventions, that would be irrelevant to the accusation.
Anyway, since the iPhone5 is "copying" Samsung's 16:9 display aspect ratio, I find that to be every bit as convincing as any "rounded corners," as proof of copying a design.
I don't think Apple is doing itself any favors by continuing with this. Even their faithful devoted are going to wonder about these tactics, sooner or later.
