Yes, I also believe it is against the law here in the U.S., but that doesn't prevent it from happening, it merely discourages it from happening explicitly.

@sanjib, corporations conspiring to do things together against consumers and employees -- like fixing prices or driving down the salary of employees -- is against the antitrust law, I believe.

Are there any laws about fair employment practice in US which prevent this kind of anti poaching settlement between competitors? If this continue to happen and the companies mal-practicing this kind of settlement escapes this easily without government intervention, employees would continue to suffer.

On a more serious note, though, Pablo, what needs not to be confused is the difference between "code of honor" and what's being illegal.

Sure, a company can talk to another company about the said employee (and get "permission"), but it is a whole different thing when big corporations' CEO get together and make a pact. That's collusion.

I agree, tpfj. I don't know how they actually divid the money in such a class action suit, but this seems like so little. In contrast, for those big corporations involved in the suit, this was a mere champ change.

IMHO they got off lightly at ~$4500 per engineer if the numbers are correct. That's about what inflation is running at for a single year.

Rick, there are some more suttle hiring agreements in the tech industry. Taiwanese tech companies in Silicon Valley have always refrained from hiring anyone from any other Chinese or Taiwanese firm without permission from them, nor any of their employees will dream to offer his/her services to another company without his/her boss blessing. And that is nothing compared with the code of honor in countries such as Japan.
