Broadcom cites Qualcomm's standards moves in new lawsuit

COLORADO SPRINGS, Colo. — Just as lawsuits between Qualcomm Inc. and Broadcom Corp. were moving toward settlement, Broadcom filed new litigation in a California state court Thursday (April 12) claiming that Qualcomm has engaged in a pattern of unfair behavior before international standards bodies.

The 37-page lawsuit filed in Orange County Superior Court mentions a March court finding that Qualcomm failed to disclose its patents before the H.264 standards committee. The suit also refers to a July 2006 decision by the IEEE to suspend activity in the 802.20 group because of Qualcomm's alleged "stuffing" of the working group.

Broadcom alleged that Qualcomm violated California law by improperly concealing patents, reneging on licensing obligations and was allegedly "exerting dominance through hidden affiliations."

The suit also claims the behavior took place acrossed standards efforts for cellular telephony, video compression and mobile broadband standards.

Broadcomm's suit also alleges that Qualcomm commited fraud, breach of contract, and violated California's unfair competition statute.
